MINUTES: September 14, 2006 Closed Record Hearing on the Vodnick Lane Plat as on file in the offfice of the City Clerk.
Vodnick Lane Closed Record Hearing and Remand Request:
The Closed Record Hearing on the Vodnick Lane PUD was called to order in the Sultan Community Center by Mayor Tolson. Councilmembers present: Champeaux, Slawson, Seehuus, Flower, Blair and Boyd. Absent: Wiediger
There were no objections to the Council participation. Mayor Tolson noted for the record that he has an outside relationship with the owner of the property.

Staff: Rick Cisar, Community Development Director, reviewed the staff report and the Hearing Examiner's recommendation. The applicant has requested that the matter be remanded back to the Hearing Examiner to allow the applicant to modify the application based on the Hearing Examiner's recommendation. The issues that need to be resolved include level of service for police, transportation issues and site problems. The main issue with the plat is the minimum lot size for PUD's. The current code allows for two acres but the application was vested under the five acre minimum. Staff has recommended that the matter be remanded back to the Hearing Examiner.

Public Input;
Josie Fallgatter: Advised that she is a party of record in this matter and she did not received notice of the closed record hearing. The Council can not consider additional information that was not part of the record and the decision on the Skoglund Estates PUD was made after the open record hearing. Noted that staff allowed the application to be submitted during the PUD moratorium. The resolution presented appears to be based on the applicants request and not the Hearing Examiner recommendation. Any decision must be based on the code and the developer can't pick and chose which codes he would like to vest under.

Council discussed the minimum lot size proposed in the development, the PUD moratorium and the plat submittal and the definition of "counter" complete applications.

On a motion by Councilmember Seehuus, seconded by Councilmember Champeaux, the closed record hearing was closed. All ayes.
