RAMIREZ TWIN RIVERS ESTATES CLOSED RECORD HEARING

Held Sept. 14, 2006 during council meeting


Twin Rivers Closed Record Hearing and Remand Request:
The Closed Record Hearing on the Twin Rivers PUD was called to order by Mayor Tolson. Councilmembers present: Champeaux, Slawson, Seehuus, Flower, Blair and Boyd. Absent: Wiediger
There were no objections to the Council participation.

Staff: Rick Cisar, Community Development Director, reviewed the staff report and the Hearing Examiner's Recommendation. The applicant has requested that the matter be remanded back to the Hearing Examiner to allow the applicant to modify the application and provide the information identified in the Hearing Examiner's recommendation.

Applicant: David Gipson, representing Ramirez, advised that the applicant has requested a remand in accordance with the Hearing Examiner's recommendation. They do not want to have any new issues addressed, only those in the original recommendation. Completeness of an application is in a manner defined by the city planner.

Public Input;
Kerry Ourada: The Hearing Examiner was clear on his decision. The applicant did not comply with the moratorium and the application was not complete. Just because the Council ignored the level of service for the Skoglund Plat does not mean they can do that for this one. The Council needs to consider the level of service moratorium issues.

Josie Fallgatter: Asked why there is no resolution to accept the Hearing Examiner recommendation. The Hearing Examiner found fault with the application in three areas which included the PUD, concurrency and shoreline management. There is no commitment for water/sewer service, it does not tie into the bike/pedestrian system and it does not meet the criteria for a PUD. Asked why the city has codes if they aren't followed?

On a motion by Councilmember Seehuus, seconded by Councilmember Flower, the closed record hearing was closed. All ayes.
