SUBJECT: Presentation DRAFT reports Critical Areas and Best Available Science

SUMMARY: Paul Inghram of Bureau Veritas Berryman and Henigar has prepared the attached reports for the update of the City of Sultan’s Critical Areas Regulations. Included with the Memo are copies of a DRAFT Critical Areas Regulations and a Draft Best Available Science Review.
Paul will provide City Council with an overview of the two reports and thereafter recommend Council review the documents and provide Staff with their written comments which can include notes or marked up copies of the two reports. Paul will also respond to Council comments.
Staffing Needs
The Public Works Department in 2005 operated one person short 56% of the time due to the L & I injury of one of the employees. As of this date, it does not appear that the employee will be released to return to work. At this time, I would like to advertise and hire a temporary Utility Worker that could become a permanent employee when we receive L & I final findings and conclusion.
Streets
Community Transit Bus Stop
There is an attached report on the west end of the City on the south side of US 2.
Sultan Basin Road
Sultan Basin Road went to bid on January 11, 2006. The bid opening will be February 7, 2006 at 3:00 pm at Snohomish County Public Works Department. Plans and Specifications are available at Snohomish County Public Works, 2nd Floor, Administration Building-East, 3000 Rockefeller Avenue, Everett, Washington from January 18, 2006 until February 7, 2006 for a fee of $50.00, non-refundable. Also, there is one copy available at Sultan City Hall for examination.
5th Street Signal:
ACTIVATION WAS TUESDAY, JANUARY 24, 2006. Now I am sticking my neck out, daring or inane, I am not sure which at this point, will let you know Wednesday night at Council.
The Public Works Crew has been out pruning street trees and trees along easements to prevent damage to City equipment, such as the new garbage truck, for the last two months. The City of Sultan Chipper is currently broke down, but we will need to repair it before the
February 25, 2006 City Wide Curb Side Chipping Day.
Water
The Water Treatment Plant is operating well. The water has a pale tea color because of the rain, but it is NOT harmful to your health.
Wastewater
From January 1 to 16, 2006 the City of Sultan experienced 8 ¼ inches of rainfall. On Tuesday, the 10th,flow into the plant was 1.411 million gallons of sewage. By staying within the DOE parameters, it shows the improvements the City has accomplished are of great value and future work will only improve plant performance.
Staff is taking extra time in research and in regards of the WWTP Facilities Plan in the purchasing of dewatering equipment to meet all requirements for present and future.

I have been gathering information from Mill Creek, Monroe, and Mt. Vernon regarding Ordinances and the Formation of their Surface Water Utility.
Cemetery
The City Crew has started pruning trees and shrubs in the cemetery. They work out there intermittently as time permits.
General Information
At the City/School/Fire Meeting we have been discussing the formation of a Sultan Basin Emergency Preparedness Alliance (SBEPA). The alliance purpose would be to plan, coordinate, negotiate and advise and support area governing bodies in emergency preparedness as needs arise such as a flood. Suggested members would be Sky Valley Chamber, School District #311, Fire District #5, Hospital District, City of Sultan and possibly City of Gold Bar and Snohomish County Red Cross.

At the January 11, 2006 Council Meeting Community Transit and Washington State Department of Transportation present an offer to relocate the existing bus stop which is opposite of 625 West Stevens on US 2.
Attached is the proposed relocation of the CT Bus Stop closer to the controlled intersection of Old Owen/Fern Bluff Rd and US 2.

The regular meeting of the Sultan City Council was called to order in the Sultan Community Center by Mayor Tolson. Councilmembers present: Champeaux, Wiediger, Slawson, Seehuus, Flower, Blair and Boyd.

COMMENTS FROM THE PUBLIC
Josie Fallgatter: Advised that she asks questions so that she will know and understand issues, however, the answers have been contradicting. When asked about a capital facility plan, she was told it was not needed but she provided proof that it was needed. Asked what she should do to get answers, why was Berryman & Henigar paid for the water and sewer plans and why didn’t the city get what they paid for. Asked if the problem is with the questions or the answers?
Al Robinson: Provided information on the Sultan School District Maintenance and Operation bond levy which will be on the February ballot.
Jeff Akins: Requested that council do something about the parking on the corner at 8th and Fir before an accident occurs.
Presentations:
State of Washington: Donna Murphy introduced Jerry Handfield and Diane Shanks who presented a check for the records management grant.
Prothman Report: Greg Prothman and Kathy Osser presented the organizational review and recommendations. They discussed the poor financial condition of the city which is due mostly from the tax initiatives and lack of sales tax revenues in the community. The City has lost 33% of general fund revenue over a four year period and needs to cut services or increase revenues. This year there will be a positive fund balance in the general fund and the city needs to continue to build reserves. The other problem is the small town organizational structure and the lack of planning. Staff members are being asked to perform two full time jobs and can not effectively do the work. It was recommended that the City Administrator/Planner and Clerk/Treasurer positions be eliminated and replaced with a City Administrator, Finance Director, City Clerk and Community Development Director and that the city hire a senior planner to keep work in house instead of hiring consultants. Personnel lost in the Police Department and Public Works need to be replaced to provide needed services. Additional revenues could be obtained by increasing the Real Estate Excise tax and placing a utility tax on the water, sewer and garbage. Also recommended that the city follow the audit recommendations and implement the new financial software system.
Community Transit/WSDOT: Mike Burris, Community Transit and Doug Ho, WSDOT were present to discuss the safety issues with the bus stop on Highway 2 across from the Medical Center. WSDOT feels the bus stop could be relocated to an area near the crosswalk and light on the west end of the city and they are willing to design and fund the project. Community Transit has agreed to the relocation. Mayor Tolson thanked the agencies for taking the initiative to provide funding a new location for the bus stop.

STAFF REPORTS:
Police Department: Advised that the Highway 2 Safety Coalition [G.R.I.T. CORRECTION: The Coalition has changed its name from “Highway 2 Safety Coalition” to the “U. S. 2 Safety Coalition.”] is working on funding and safety concerns with the state representatives. The safety and capacity issues need to be addressed.
Public Works: Sultan Basin Road project went out to bid today. 5th Street signal – contractor will be working with the railroad next week to install the signal. Water now has fluoride in the system.
Grant Report: The Community Awards night will be on February 18th and the citizen of the year will be announced at that time. The contracts for the Reese and Sportsman Park improvement projects have been received for signatures.
Finance: Presented the final 2006 Budget document and recommended that the Council take time to read the information sections.
Karstan Thot: Advised that the ASB Board met with the district finance director to discuss the budget funding for 2006.

Connie Dunn, Public Works Director, discussed the public work fees and the cemetery fees. On a motion by Councilmember Champeaux, seconded by Councilmember Flower, Resolution 05-32, 2006 Fee Schedule, was adopted. All ayes.
Copier Lease: The bids for the copy machine at the Police Department were presented for review. On a motion by Councilmember Blair, seconded by Councilmember Seehuus, the bid from QBS for a leased copy machine was accepted. All ayes.

CITY OF SULTAN COUNCIL MEETING – Janauary 11, 2006
Mayor Pro-tem Appointment: Councilmember Boyd nominated Councilmember Seehuus as Mayor Pro-tem for 2006. On a motion by Councilmember Boyd, seconded by Councilmember Flower, Councilmember Seehuus was appointed as Mayor Pro-tem for 2006. All ayes with Councilmember Seehuus abstaining
Mayor Tolson thanked Councilmember Flower for his work as Mayor Pro-tem during 2005. Councilmember Flower advised that it was an honor to serve and participate in the Centennial events.
Mayor Tolson announced that Councilmember Flower has been appointed to the Snohomish County Health Board.
Springbrook Software Contract: The business plans were presented for the Council to review. Discussion was held regarding the Harris/ASP contract and their offer to provide a different program. Thom Graafstra advised that the city has provided proper notice to Harris to terminate the contract.
On a motion by Councilmember Seehuus, seconded by Councilmember Blair, the Mayor was authorized to sign the contract with Springbrook Software. All ayes.
Waste Water Facility Plan – Contract and Scope of Work: Connie Dunn, Public Works Director, reviewed the proposed contract from Brown and Caldwell for work on the plan for the Waste Water Treatment plant. On a motion by Councilmember Boyd, seconded by Councilmember Flower, the Mayor was authorized to sign a contract with Brown and Caldwell for work on the Wastewater Treatment Plant Facilities plan and to expand the contract to include the Gold Bar option provided that they pay the costs. All ayes.
Library Board Appointments: On a motion by Councilmember Champeaux, seconded by Councilmember Blair, the Library Board appointments were confirmed for Gina Korn, Emily Abt and Charles Van Pelt. All ayes.
DISCUSSION ITEMS:
Planning Commission: Councilmember Boyd requested that the Council consider disbanding the Planning Commission. Thom Graafstra, City Attorney, advised that an amendment to the code would be required to eliminate the Planning Commission and the city would need to create a planning agency.
Discussion was held on the effectiveness of the current commission, lack of quorum and applicants, the need to continue the public hearing process and the need to create a planning agency.
Committee Assignments: The current committee list was reviewed and new assignments were made. The revised list will be provided to the Council.
City Council Retreat: The Council retreat was set for February 11, 2006 beginning at 9:00 AM.
Council Meeting Day: Mayor Tolson requested that the Council consider changing the meeting day to Tuesday or Thursday on the 2nd and 4th weeks. Brief discussion was held regarding schedule conflicts. Staff was directed to bring back an ordinance changing the meeting day to the 2nd and 4th Thursday.
PUBLIC COMMENTS
Sue Shawger: Was sorry to hear that the Council was considering disbanding the Planning Commission and asked how the openings were advertised.
Mayor Tolson advised that information was on the cable channel, city web site and in the newspapers.

Josie Fallgatter: Noted that there have been applicants for the Planning Commission and the Mayor has stated that he rejected the last three applicants.
Loretta Storm: Disappointed that the council has decided to disband the Planning Commission. Sultan will be the only city that has a planning committee instead of Planning Commission. Thanked the Council for confirming the appointments to the Library Board.
Jean Roberts: In regards to the restructuring of the city government, would encourage the council to seek input from the community and involve as many people as possible.
Randy Oesch: Thanked the Council for taking action to straighten out problems in the city.
COUNCIL COMMENTS
Flower: Welcomed the new Councilmember and thanked Chief Walser for his work with the Highway 2 Safety Coalition. No matter which direction the city goes with the Planning Commission there will be public hearings on land use issues.
Boyd: It is not an easy decision to eliminate the Planning Commission but at this point they don’t know how the problems can be fixed. The Planning Commission is not effective and there have not been a lot of applicants.
Mayor Tolson: Thanked Ms. Mayberry for attending the meeting and advised that the city will hold her application for the Planning Commission.

There is established the position of Finance Director in and for the City of Sultan. The position is established in lieu of, but with the same powers and responsi-bilities as the position of city treasurer as defined by law.
2.08.020 Appointment
The Mayor shall have the power of appointment and removal of the Finance Director. Such appointment and removal shall be subject to confirmation by a majority vote of the City Council.
2.08.030 Powers and duties
The powers, duties and responsibilities of the Finance Director shall be subject to the direction, authority and supervision of the City Administrator, and shall include, without limitation, the following:
(1) Receive and safely keep all monies which come into the city treasury, and follow all laws of the State of Washington regarding the accountability therefor;
(2) Keep such books, accounts and make such reports as required by the Office of the State Auditor;
(3) Exercise the duties and authority of the City Treasurer as provided by Chapter 35A.42 RCW;
(4) Exercise the duties and authority of auditing officer as provided by RCW 42.24.080 as applicable to the City;
(5) In the absence of the City Clerk to perform all the duties of the City Clerk as provided by law.
2.08.040 Deputy Finance Director and Clerks
A Deputy Finance Director or Clerk, and a Utility Clerk may be appointed by the City Administrator. In the absence of the Finance Director, the Deputy Finance Director, or the Deputy Clerk shall have all of the powers and duties of the Finance Director.
2.08.050 Oath of Office
The Finance Director, before entering upon the discharge of her/his duties shall take and subscribe to an oath of office.
2.08.055 Blanket bond coverage
If available, the city shall subscribe to and maintain blanket bond coverage by and through its insurance authority. Such coverage shall be bound for the Finance Director before she/he enters upon the discharge of her/his official duties and shall be in an amount of not less than $10,000.
Should blanket bond coverage not be available, the Finance Director, before entering upon the discharge of her/his duties, shall enter into an individual faithful performance bond in the amount of not less than $10,000 with a surety approved by the Mayor. The premium on such individual faithful performance bond shall be paid by the city.
2.08.060 Salary
The Finance Director shall receive a salary in such amount as the City Council may from time to time establish by ordinance for a permanent hire, and such amount as the Mayor may negotiate and the City Council approve by resolution for an interim appointment.
Section 3. If any section of this ordinance, or if any subsection or part shall be declared unlawful, the balance of this ordinance and of each section shall remain in full force and effect.
Section 4. This Ordinance shall become effective on: ______________, 2006.

It is hereby ordained by the City Council of the City of Sultan, Washington as follows:
Section. 1. Section 2.09.020 Sultan Municipal Code is amended to read as follows:
2.09.020 Scope of Authority
The City Engineer shall perform or supervise the performance of the City Engineer’s duties as designated by this code and as assigned by contract. The City Engineer shall act under the direction and authority of the Public Works Director who shall in turn report to and act under the authority of the City Administrator.
Section 2. Section 2.09.030 E Sultan Municipal Code is amended to read as follows:
E. Assist the Public Works Director with technical issues related to public works, transportation and general city engineering topics;
Section 3. If any section of this ordinance, or if any subsection or part shall be declared unlawful, the balance of this ordinance, and of each section shall remain in full force and effect.
Section 4. This Ordinance shall become effective on: ______________, 2006.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SULTAN WASHINGTON AMENDING SECTIONS 2.10.020 AND 2.10.020 SO THAT THE CITY ADMINISTRATOR SHALL NOT SERVE AS THE CITY PLANNER AND ALL CITY OFFICERS SHALL REPORT TO THE CITY ADMINISTRATOR.
It is hereby ordained by the City Council of the City of Sultan, Washington as follows:
Section 1. Section 2.10.020 Sultan Municipal Code is hereby amended to read as follows:
2.10.020 Scope of Authority
The City Administrator shall be administrator, executive, and liaison officer for the city, under the direction and authority of the Mayor.
Section 2. Section 2.10.030 Sultan Municipal Code is hereby amended to read as follows:
2.10.030 Duties
The City Administrator, under the direction and authority of the Mayor, shall have the following specific duties, powers and responsibilities:
1. Supervise, administer, and coordinate the activities and functions of the various city officers, departments, commissions, and boards in carrying out the requirements of the city ordinances and the policies of the City Council and to administer and supervise the carrying out of the decisions and policies of the various city departments, commissions and boards; provided however, that with respect to the Police Department, the City Administrator shall oversee the department budget and act as liaison between the Chief of Police and the Mayor;
2. Regularly report to the Mayor concerning the status of all assignments, duties, projects, and functions of the various city officers, departments, commissions, and boards;
3. Assist in the preparation and subsequent submission to the City Council of the annual budget and be responsible for its administration in accordance with law after its adoption;
4. Serve as personnel officer for the city under the supervision of the Mayor;
5. Supervise all purchasing by the various city offices, departments, commissions and boards;
6. Supervise all expenditures by the various city officers, departments, commissions, and boards for the purpose of keeping the same within the limitations of the annual budget of the city so much as possible, and attending to the amendment of the budget as necessary;
7. Attend all meetings of the City Council and such other meeting as may be requested by the Mayor;
8. Recommend for adoption by the City Council and approval by the Mayor such measures as deemed necessary or expedient in the running of the business of the city;
9. In conjunction with the Finance Director, Auditor and the City Attorney to keep the Mayor and City Council fully advised of the financial condition of the city and its future needs, and to assist in the preparation and submission to the Mayor and City Council of any reports necessary for the expedient running of the business of the city;
10. Investigate all complaints in relation to matters concerning the administration of the government of the city and in regard to the service maintained by public utilities in the city, and to see that all franchises, permits and privileges granted by the city are faithfully observed;
11. Assist the Police Chief, Building Official, Director of Community Development and all departments of the city in administering all ordinances subject to licensing, taxing, and inspections of buildings and developments within the city;
12. Make, compile and file with the City Clerk a complete inventory of the property, real and personal, owned or leased by the city and file amended inventories thereof at least semi-annually as to stock supplied and equipment, and annually as to all other properties.
Section 2. If any section of this ordinance, or if any subsection or part shall be declared unlawful, the balance of this ordinance, and of each section shall remain in full force and effect.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SULTAN, WASHINGTON ABOLISHING ITS PLANNING COMMISSION AND ESTABLISHING A DEPARTMENT OF COMMUNITY DEVELOPMENT AS ITS PLANNING AGENCY WITH A CITIZENS ADVISORY GROWTH MANAGEMENT BOARD BY REPEALING CHAPTER 2.17 SULTAN MUNICIPAL CODE AND ENACTING A NEW CHAPTER 2.17 SULTAN MUNICIPAL CODE ENTITLED “DEPARTMENT OF COMMUNITY DEVELOPMENT” AND REPEALING SECTIONS 16.120.010 AND 16.120.020 SULTAN MUNICIPAL CODE.

2.17.010 Department created
There is created a separate administrative department in and for the City of Sultan entitled the Department of Community Development, to consolidate all planning, environmental and permitting functions into a single department under the supervision of a Director of Community Development.
2.17.020 Designation as planning agency, planning commission
The Department of Community Development is hereby designated as the planning agency for the City of Sultan to perform all duties, directly or indirectly, by contract or agreement, required of a planning agency as imposed by law. Where provisions in the city’s Municipal Code reference a “planning agency” or a
“planning commission”, from and after the effective date of this section such references shall refer to the Department of Community Development.
2.17.030 Position established
There is established the position of Director of the Department of Community Development in and for the City of Sultan.
2.17.040 Appointment
The Mayor shall have the power of appointment and removal of the Director of the Department of Community Development. Such appointment and removal shall be subject to confirmation by a majority vote of the City Council.
2.17.050 Powers and duties of director
The powers, duties and responsibilities of the Director of the Department of Community Development, except where the Director may act in a quasi-judicial manner, shall be subject to the direction, authority and supervision of the City Administrator, and shall include, without limitation, the following:
1. Perform, or cause to be performed for the City all duties imposed on a planning agency under law;
2. Issue administrative determinations under the city’s Unified Development Code;
3. Serve as the city’s designated official under the State Environmental Policy Act (“SEPA”);
4. Perform directly, or by designee all duties imposed on officials of the City of Sultan under Titles 15, 16, 17, 21 and 22 of the Sultan Municipal Code;
5. Appoint and supervise the performance of a senior planner, and such permit technicians as authorized by the city’ annual budget;
6. Except where he/she acts in a quasi-judicial capacity, supervise the performance of the city’s building official and the city’s code enforcement officer;
7. Participate in and prepare an annual budget for the Department of Community Development; and
8. Cause to be performed the duties of the Department of Community Development as established by this chapter.
2.17.060 Salary
The Director of the Department of Community Development shall receive a salary in such amount as the City Council may from time to time establish by ordinance for a permanent hire, and such amount as the Mayor may negotiate and the Council approve by resolution for an interim appointment.
2.17.070 Senior planner and staff
A senior planner and staff as authorized by the city’s budget may be appointed by the Director of the Department of Community Development.
2.17.080 Citizens Growth Management Advisory Board
There is hereby established, on the terms and conditions of this section, a Citizens Growth Management Advisory Board (the “Board”):
1. Purpose. The purpose of the Board is two fold: (1) where requested by the Department of Community Development to receive public input and participation on matters referred to the Board and to conduct a meeting or hearing and (2) to provide comment on (a) the city’s public participation processes to comply with Chapter 36.70A RCW, (b) compliance of the city’s comprehensive plan with the requirements of Chapter 36.70A RCW, (c) compliance and consistency of the city’s development regulations, and other plans such as the city’s general sewer plan with the city’s comprehensive plan, and (d) internal consistency of the city’s development regulations.
2. Membership. The Board shall consist of seven (7) members, one Council representative, a representative of the School District 311, a Public Safety representative, a Downtown property owner and Chamber member, a Sultan Scenic Business Park business owner and two (2) citizens appointed by the Mayor and confirmed by the City Council. The term of appointment shall be two (2) years. A person may not serve more than 2 terms consecutively.
3. Vacancies. A vacancy on the Board shall occur if a member resigns, moves his/her residence or business from Sultan or the School or Fire district or misses four (4) functions of the board within a one (1) year period of time.
4. Removal from Board. The Mayor may remove a member from the Board by notice to the member and copied to the City Council. Unless the Council by four votes shall override the decision of the Mayor, the member shall be removed in accordance with the Mayor’s notice.
5. Meetings. The Board shall hold an organizational meeting in January of each year. The Board also shall hold a meeting in April and October of each year at a minimum. Additional meetings shall be held at the request of the Director of the Department of Community Development or when a majority of the Board shall designate. All meetings shall be public meetings, and notice shall be given in accordance with law. No person shall have a right of appeal to the Board. The Board may make a recommendation only when a quorum is present and a majority of those present at a meeting where a quorum is present agr
