DETERMINATION OF SIGNIFICANCE

AND REQUEST FOR COMMENTS ON SCOPE

OF THE ENVIRONMENTAL IMPACT STATEMENT

DESCRIPTION OF PROPOSAL:

The applicant is requesting a rezone from Forestry (F) to Mineral Conservation (MC) of 612 acres concurrent with conditional use permit approval to excavate and process sand and gravel from 230 acres within the larger parcel. Portable asphalt and concrete plant operations as well as the acceptance of clean fill are also proposed for site operations.

Location of Proposal: The site is located approximately 3 miles east of the Town of Gold Bar on the south side of State Route 2, in Sections 14 & 15, Twp. 27 N, Rge. 9 E, W.M.

Lead Agency: Planning and Development Services

THRESHOLD DETERMINATION :

The lead agency has determined that this proposal is likely to have a probable, significant adverse impact on the environment. An environmental impact statement is required under RCW 43.21C.030(2)(c). This decision was made after review by Snohomish County of the permit application and accompanying documents.

The lead agency has identified the following areas for discussion in the EIS:

Earth: Type and magnitude of potential erosion and slope stability impacts resulting from the excavation of sand and gravel from the site and discussion of existing geologic erosion and slope stability hazard areas on site and in the vicinity;

Air: Quantitative measurement and description of anticipated impacts of particulates generated by mining operations and truck traffic;

Water: Proposed storm water drainage system, source and quantity of water used in mining operations, surface and groundwater flow alterations resulting from the proposed mining activity, including the potential for impact to the Skykomish River, Proctor Creek and vicinity wells; potential impacts to surface and groundwater quality, wetland impacts as a result of mining, including direct impacts (loss) and indirect impacts resulting from changes in surface and groundwater conditions on site;

Noise: Identification of noise sensitive land uses in site vicinity, proposed noise sources including mining equipment and truck loading, evaluation of noise impacts on surrounding land uses;

Plants: Assessment of impacts from clearing of on site vegetation, identification of sensitive plant species;

Animals: Identification of any Endangered, Threatened or Sensitive species, assessment of impacts to animal communities as a result of direct habitat loss, description of fisheries conditions in the site vicinity, including the Skykomish River and Proctor Creek systems;

Land and Shoreline Use: Land Use compatibility of proposed action with surrounding land uses, consistency of the proposed land use action with applicable Snohomish County adopted plans, policies and regulations;

Aesthetics: Description of visual conditions during proposed mining and at completion of site reclamation;

Transportation: Volume of project-generated vehicular traffic, description of vehicular traffic impacts related to roadway operation, site access, sight distance and roadway safety with emphasis on State Route 2.

SCOPING:

This Determination of Significance and scoping notice is issued under WAC 197-11-360 and is subject to a 21-day scoping comment period and a concurrent appeal period which extends 7 days beyond the scoping comment period. Agencies, affected tribes, and members of the public are invited to comment on the scope of the EIS. Written comments should be submitted to the lead agency at the address below. Comments must be received 21 days from the date of issuance of this DS and scoping notice, publication of notice or posting of the property, WHICHEVER OCCURS LATER.

APPEALS:

This DS may be appealed pursuant to the requirements of Section 23.40.022 SCC and Chapter 2.02 SCC, within the 28-day appeal period. Any appeal must be addressed to the County Hearing Examiner, accompanied by a filing fee of $100.00, and be filed in writing at the Public Assistance Counter on the Fifth Floor, County Administration Building, Everett, WA. The appeal must contain the items set forth in Subsection 2.02.125(2) SCC as follows:

    1. specific identification of the determination being appealed (including the local file number) and a complete copy of the document being appealed must be filed with the appeal;
    2. specific identification of the county code provision which authorizes the appeal (Section 23.40.022 SCC)
    3. the specific grounds upon which the appellant relies, including a concise statement of the factual reasons for the appeal and, if known, identification of the policies, statutes and codes or regulations that the appellant claims are violated. A specific listing of the environmental elements alleged to be inadequately or inappropriately addressed in the environmental document and the reasons therefore shall be included;
    4. name, mailing address and daytime phone number of each appellant together with the signature of at least one of the appellants or of the attorney for the appellant(s), if any;
    5. name, mailing address, daytime phone number and signature of the appellant’s agent or representative, if any; and
    6. required filing fee of $100.00.

Please note that failure to file a timely and complete appeal including all the above items shall constitute waiver of all rights to an administrative appeal under county code.
