RESOLUTION NO. _______________
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GOLD BAR, WASHINGTON, TO ESTABLISH TEMPORARY POLICY TO LIMIT LEGAL EXPENDITURES.
WHERE AS, the City of Gold Bar has limited financial resources and cannot afford to spend more than budgeted,
WHERE AS, the City has in the past two years spent more than budgeted for legal expenses,
WHERE AS, there is excellent free legal advice that the City can take advantage of; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF GOLD BAR, WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. That no legal expenditure no matter how small be incurred and billed to the City without the following:
A. Consensus approval of a majority of the City Council.
B. This Consensus approval communicated in writing by the Mayor Pro Tem or his\her designee to the City Attorney or his/her designee.
Section 2. Any Gold Bar City representative which includes but is not limited to the following: the Mayor, City Clerk and other staff members, and Council Members cannot contact the City Attorney requesting services resulting in any cost to the City without specific approval granted by a majority of the City Council at one of its meetings. Council meetings here should be construed to include both regular and special.
Section 3. Failure to get required permission will allow the City Council to refuse to pay all resulting legal bills and if required to pay said bills, the Council will request reimbursement for all costs from the violator of this resolution.
Section 4. It is the responsibility of the Mayor Pro Tem to communicate in writing the contents of this resolution and if necessary explain the working of this resolution to the City Attorney.
