| The city did not have any HPA permit from Washington Fish & Wildlife (WFWD) to perform this work, even given its pattern and history of disregard for following proper procedures. Tony Opperman, the representative from F&W at the time, said he had given the city a "verbal okay to perform 'hand work'" to remove the dam, the definition of which included specific methods by which water was to be released slowly through a "trickle tube" in a measured and monitored manner in order to prevent the type of situation that is displayed on this page -- that is, in a "flash flood" type of water movement through the creek. When viewed at approximately 7 p.m. on the evening of May 31, 2001, the creek level was quite high, similar to its level during extremely wet and rainy periods. |
